Rules of the Mobellia x Ogre competition

Article 1: Organizing Companies

The company MOBELLIA, SAS with capital of €100,000, whose head office is located at 1165, avenue Jean René Guillibert Gauthier de la Lauzière – 13290 Aix-en-Provence – France, registered with the RCS of Aix en Provence under number B 841 403 678, as well as,

The company Ogre la Fabrique, SAS with share capital of €7,500, whose head office is located at 10 passage lathuille, 75018 PARIS, France, registered with the RCS of PARIS under number 890 597 677.

are organizing a free competition with no obligation to purchase from 05.24.2024 at 2:30 p.m. to 05.31.2024 at 3:00 p.m. The operation is entitled: “MOBELLIA x OGRE LA FABRIQUE Instagram competition”.

Article 2: Conditions of Participation

This game is open to any individual residing in metropolitan France (including Corsica) who wishes to participate for free from the Instagram account @mobellia_design: https://www.instagram.com/mobellia_design/ and/or that of @ogrelafabrique: https://www.instagram.com/ogrelafabrique/

The organizing companies reserve the right to carry out all necessary checks concerning the identity of the participants.

All Company personnel, as well as minors, are excluded from any participation in this Game and from benefiting from any prize.

Persons who have not provided proof of their full contact details and identities or who have provided them in an inaccurate or misleading manner will be disqualified, as will persons refusing the collection, recording and use of personal information concerning them and strictly necessary for the purposes of game management.

Participation in the Game implies for all participants full and unreserved acceptance of these regulations. Failure to comply with these regulations results in automatic cancellation of participation and possible award of bonuses.

Article 3: Method of Participation

Game progress:

Entries will be counted between 05/24/2024 at 2:30 p.m. and 05/31/2024 at 3:00 p.m.

The game proceeds as follows, the player must:

1. Having an Instagram account
2. Follow the account @mobellia_design:  https://www.instagram.com/mobellia_design/ and the account @ogrelafabrique: https://www.instagram.com/ogrelafabrique/
3. Like the post on the account @mobellia_design and/or @ogrelafabrique
4. Comment on the publication on the account @mobellia_design and/or @ogrelfabrique by tagging one or more people

Article 4: Selection of the winner

Once the draw has been made, the winner will be contacted by both companies individually by private message directly to their Instagram account through which they have won. The winner must then respond to the private message by confirming their contact details in order to send the prize which will be delivered by post. If there is no response within 3 days of contact being made, the winner will forfeit their prize and a new draw will be carried out to select a new winner.

The winner will also be mentioned in the competition publication once the game is closed.

There will be only one winner for this game. The winner will be chosen by drawing lots from the comments and in accordance with the rules of this competition. The draw will take place on May 31 at 3 p.m.

The winner must comply with the rules. If it turns out that he does not meet the criteria of these regulations, the prize will not be awarded to him. Participants authorize all verifications concerning their identity, age, postal details or the loyalty and sincerity of their participation. As such, the organizing companies reserve the right to request a copy of the winner's identity document before sending the prize. Any false declaration, indication of false identity or address results in the immediate elimination of the participant and, where applicable, the reimbursement of the prize already sent.

Article 6: Shipment of the lot

The draw will take place on May 31 at 3 p.m. The prize is neither exchangeable, nor transferable, nor refundable in whole or in part. The winner will receive their winnings by carrier, within 3 months from the end of the game. If the winner renounces their prize or cannot take possession of it for any reason whatsoever, the prize in question will remain the property of the organizing companies which will be free to reallocate it or not.

The prize is strictly personal and is neither transferable nor exchangeable for monetary value or another prize. In the event of force majeure or a particular event, the organizing companies reserve the right to replace the prize won with a prize of equivalent nature and value, without incurring liability as a result.

The organizing companies decline all liability relating to the prize offered, particularly in the event of delay or in relation to any possible dissatisfaction of the winner with the prize.

The organizing companies reserve the right to extend, shorten, modify or cancel the game at any time, without the participants being able to claim any compensation.

Article 8: Limitation of Liability

The liability of Mobellia and Ogre la Fabrique cannot be engaged in the event of force majeure or fortuitous event beyond their control, which would partially or totally deprive the participants of the possibility of participating in the game and/or the winner of the benefit of their winnings. .

The organizing companies cannot be held responsible for delays, losses, theft, transport damage, lack of legibility of stamps caused by the carriers.

The organizing companies and their service providers cannot under any circumstances be held responsible for any incidents that may occur in the use of the prize by the beneficiary or third parties once the winner has taken possession of it.

Likewise, the company Mobellia and the company Ogre manufacture it, as well as their service providers, cannot be held responsible for the loss or theft of the prize once the winner has taken possession of it. This competition is not managed or sponsored by Instagram, which the Mobellia and Ogre companies release from all liability. Instagram cannot be held responsible under any circumstances during the execution of this competition.

Article 9: Use of participants’ personal data

Participants' information is recorded and used by the companies Mobellia and Ogre manufactures it to memorize their participation in the game and allow the prize to be awarded.

Participants may, for legitimate reasons, object to their personal data communicated within the framework of this game being processed. They also have a right to object to their being used for commercial prospecting purposes, outside of participation in this game, which they can assert upon registration of their participation by contacting by mail to the address below.

In accordance with the Data Protection Act of January 6, 1978, any participant has the right to demand that information concerning him or her that is inaccurate, incomplete, ambiguous or out of date be rectified, completed, clarified, updated or deleted by sending by mail to the address: 1165, avenue Jean René Guillibert Gauthier de la Lauzière – 13290 Aix-en-Provence – France or by e-mail to the address contact@mobellia.com and/or Ogre manufactures it - 10 passage lathuille, 75018 PARIS.

Reimbursement of the costs of requesting rectification and deletion of data will be made on the basis of a simple letter of less than 20gr, franked at the economic rate.

Article 10: Disputes

These regulations are subject to French law.

To be taken into account, possible disputes relating to the Game must be made upon written request to the following address: 1165, avenue Jean René Guillibert Gauthier de la Lauzière – 13290 Aix-en-Provence – France and/or Ogre company. factory - 10 passage lathuille, 75018 PARIS. And no later than ninety (90) days after the deadline for participation in the Game as indicated in these regulations. In the event of persistent disagreement over the application or interpretation of these regulations, and in the absence of an amicable agreement, any dispute will be submitted to the appropriate court, to which exclusive jurisdiction is attributed.
