1. Scope and seller information
These Terms and Conditions of Sale (“Terms”) govern all sales of products made by MOBELLIA to consumers via the website www.mobellia.com/en.

Mobellia is a company registered and established in France.
For customers located in the United Kingdom, products are dispatched from the United Kingdom.
These Terms are drafted in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Nothing in these Terms affects the consumer’s statutory rights under UK law.
These Terms are drafted in English. In the event of any inconsistency, the English version shall prevail.
2. Legal capacity
By placing an order, the customer confirms that they are at least 18 years old and legally capable of entering into a binding contract.
3. Geographic availability
Sales via the Site are available to customers residing in the United Kingdom and in selected European countries, as indicated on the Site at the time of order.
This geographic availability may change for logistical reasons and will be updated on the Site.
4. Product information and availability
The essential characteristics of the products, including specifications, dimensions and materials, are described on the Site.
Product offers are subject to availability. In the event that a product becomes unavailable after an order is placed, the customer will be informed and refunded accordingly.
5. Prices, VAT and delivery charges
Prices displayed for UK customers are expressed in pounds sterling (£) and include UK VAT where applicable.
Delivery charges are not included in the product price and are shown separately before order confirmation.
Mobellia reserves the right to modify prices at any time. The price applicable is the one displayed on the Site at the time the order is placed.
An invoice is issued and sent to the customer by email upon order confirmation.
6. Orders and contract formation
Orders may be placed on the Site 24 hours a day, 7 days a week.
Before placing an order, the customer is given the opportunity to review the order details and correct any errors.
The contract is concluded when Mobellia sends an order confirmation email to the customer.
Mobellia reserves the right to refuse or cancel any order in the event of payment issues, fraud, or a dispute relating to a previous order.
7. Payment
Payment must be made in full at the time of order.
Accepted payment methods include:
– Bank cards (Visa, MasterCard, Carte Bleue, American Express)
– PayPal
– Bank transfer
– Alma (four instalments, subject to eligibility)
Payments are processed via secure payment providers. Payment data is encrypted and handled in accordance with PCI DSS standards.
8. Delivery
Products ordered by UK customers are delivered within the United Kingdom.
Estimated delivery times are indicated on the Site and may vary depending on logistical constraints.
Delivery is made to the address provided by the customer at the time of order. Delivery dates are estimates and are not guaranteed.
9. Right to cancel (Consumer Contracts Regulations 2013)
9.1 Cooling-off period
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the customer has the right to cancel the contract within 30 days without giving any reason.
The cancellation period expires 30 days from the day on which the customer, or a third party designated by the customer, takes physical possession of the goods.
9.2 How to cancel
To exercise the right to cancel, the customer must inform Mobellia of their decision by a clear statement sent by email to contact@mobellia.com.
9.3 Return of goods
The customer must return the goods without undue delay and no later than 30 days after notifying cancellation.
Unless the goods are faulty or not as described, the customer bears the direct cost of returning the goods.
All returned products must be sent back perfectly intact and in their original packaging. No returns will be accepted if the products are not repackaged by the Customer, and if they have been visibly used and/or damaged by the Customer, making the products unsuitable for sale.
9.4 Refunds
Upon valid cancellation, Mobellia will reimburse all payments received, including the cost of standard delivery, within 14 days of receiving the returned goods or proof of return.
Where the customer has chosen a delivery method other than the least expensive standard delivery offered, only the cost of standard delivery will be refunded.
Refunds are made using the same payment method used for the original transaction.
This right to cancel does not affect the consumer’s statutory rights.
10. Statutory rights (Consumer Rights Act 2015)
Nothing in these Terms and Conditions limits or excludes any statutory rights granted to consumers under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.
Under UK law, consumers have the right to reject faulty goods within 30 days, to request repair or replacement, and to request a price reduction or refund where applicable.
11. Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded under UK law.
Mobellia shall not be liable for damage resulting from misuse, negligence, lack of maintenance, normal wear and tear, or events beyond its reasonable control.
Product images and illustrations on the Site are provided for indicative purposes only and are not contractually binding.

13. Personal data
Personal data is processed in accordance with the UK GDPR and the Data Protection Act 2018.
Further information regarding data processing and consumer rights is available in the Privacy Policy on the Site.
14. Intellectual property
All content on the Site is the exclusive property of Mobellia and is protected by applicable intellectual property laws.
Any reproduction or use without prior written consent is strictly prohibited.
15. Alternative dispute resolution (ADR)
Consumers may use an Alternative Dispute Resolution (ADR) provider approved in the United Kingdom to attempt to resolve disputes.
Mobellia is not obliged to participate in ADR but will consider such requests in good faith.
16. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of England and Wales.
The courts of England and Wales shall have jurisdiction over any dispute arising from these Terms.
